David S. Jarrett Associate

After graduating with his LL.B., David completed a 10 month clerkship with the Court of Appeal of Alberta in Edmonton and then finished his articles with Brownlee LLP, a leading Alberta firm.  Following his call to the Alberta Bar and his continued work at Brownlee LLP as an associate, David focused on general commercial litigation including contractual disputes, ownership of title to land issues, collections, commercial lease disputes, builders’ liens matters and bankruptcy and insolvency.

David currently practices civil and commercial litigation and works closely with senior members of the firm on a broad range of legal matters including issues of maritime law involving vessel arrest, collision, pollution and bodily injury in addition to non-maritime contract, insurance and employment matters. David also handles small claims matters and general bodily injury claims.

David has appeared before the Federal Court, the B.C. Provincial Court and the B.C. Supreme Court, as well as the Alberta Provincial Court and the Alberta Court of Queen’s Bench.

Representative Cases

FFS HK Ltd. v. “P.T. 25” (The), 2010 BCSC 1675: Acted as co-counsel to a senior member of the firm in defending a vessel owner for a claim for damages arising from a spill of bunkering fuel and successfully arguing that its apportionment of the damages be set at 50%.

Employment law: Defended an employer in a Provincial Court action brought by a former employee seeking damages for wrongful dismissal and elevated damages due to the manner of termination.

Assisted senior counsel at the firm with maritime matters relating to vessel and cargo arrest, enforcement of maritime liens, priority disputes, tug and tow, collisions, personal injury and property damage.  This work includes on board emergency response on behalf of vessel owners.
